The Mental Health Act (1983) is the main piece of legislation that covers the assessment, treatment and rights of people with a mental health disorder.
In most cases when people are treated in our mental health services, they have agreed or volunteered to be there. If a person with a mental illness isn’t able or willing to be involved in decisions about treatment because of their condition doctors and AMHPs (Approved Mental Health Professionals) and nursing staff have to use the powers given to them under the Mental Health Act to insist on medication or a stay in hospital. This is known as being sectioned.
The mental health legislation department is responsible for the administration of all Mental Health Act documentation throughout the trust. They:
- Act as a source of advice and support in all aspects of mental health legislation.
- Coordinate hospital managers hearings and tribunals for all detained and community treatment patients.
- Provide training on all aspects of mental health legislation throughout the trust.
- Ensure the Trust is compliant with the Mental Health Act 1983.
The department reports internally on Mental Health Act activity on a quarterly basis.
